§ 13.01.150. Evidence of doing business.

  • (a)

    When any person shall by use of signs, circulars, cards, telephone book or newspaper advertisements, via social media or the Internet, holds out or represents that such person is in business in the City, or when any person holds an active license or permit issued by a governmental agency indicating that such person is in business in the City, and such person fails to deny by a sworn statement given to the City Clerk that such person is conducting a business in the City after being requested to do so by the City Clerk, then these facts shall be considered prima facie evidence that such person is conducting a business in the City.

    (b)

    If any section, subsection, sentence, phrase, portion or part of this chapter is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this chapter. The City Council hereby declares that it would have adopted the ordinance from which this chapter is derived and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases, parts or portions be declared invalid or unconstitutional.
